Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the use of services provided by [Property Management Company Name] ("Company", "we", "us", or "our") to property owners, tenants, and other parties involved ("you", "your", or "Client"). By using our property management services, you agree to comply with these Terms.

2. Services Provided

The Company offers property management services that include, but are not limited to:

  • Property leasing and tenant placement

  • Rent collection and financial management

  • Property maintenance and repairs

  • Lease agreement enforcement

  • Tenant communication and conflict resolution

A detailed list of services will be provided in the specific contract or agreement between the Company and the Client.

3. Client Responsibilities

The Client agrees to:

  • Provide accurate and timely information regarding the property.

  • Maintain the property in a good condition for occupancy.

  • Pay all management fees and charges as outlined in the service agreement.

  • Comply with all local, state, and federal laws, regulations, and ordinances.

4. Management Fees and Payments

The Client agrees to pay the Company fees for services rendered, as outlined in the service agreement. Payment terms, including frequency and due dates, will be established and must be adhered to.​

  • Other Fees: Additional fees may apply for services such as maintenance, evictions, or legal consultations. These will be specified in the agreement or invoiced separately.

5. Tenant Selection and Leasing

The Company will conduct tenant screening and selection based on the criteria agreed upon in the management agreement. The Company reserves the right to reject tenants who do not meet the required standards.

  • The Client authorizes the Company to sign lease agreements on behalf of the property owner and to enforce the terms of such leases.

6. Maintenance and Repairs

  • The Company will manage routine maintenance and repairs of the property, using contractors or vendors as necessary.

  • The Client authorizes the Company to approve repairs up to a specified amount without prior approval. For larger repairs, the Company will seek the Client’s approval before proceeding.

7. Liability and Insurance

  • The Company will not be liable for any damage to property or injury occurring on the property, except in cases of gross negligence or willful misconduct.

  • The Client is required to maintain appropriate property insurance and to ensure that the property is adequately insured against potential risks (e.g., fire, theft, liability).

8. Tenant Payments

  • The Company will collect rent payments from tenants on behalf of the Client.

  • The Company will make reasonable efforts to ensure timely payments but is not responsible for tenant non-payment.

  • The Client will be responsible for any unpaid rent or other fees owed by tenants.

9. Termination of Services

  • Give a 24 hour notice if cancelling a showing appointment.

10. Confidentiality

The Company will treat all personal, financial, and property information provided by the Client and tenants with strict confidentiality. This information will only be shared as necessary for the execution of the management services.

11. Dispute Resolution

Any disputes arising from the Terms or the property management services will be resolved through arbitration/mediation or, if necessary, in the appropriate court of law.

12. Force Majeure

The Company shall not be held liable for failure or delay in performance of services due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or government restrictions.

13. Amendments

The Company reserves the right to amend these Terms at any time. The Client will be notified of any changes, and continued use of services after such notification will constitute acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
